Independent Medical Evaluation and Impairment Evaluation

California (Civil), Nevada, Hawaii, Federal Maritime (Jones Act and Longshore)

Dr. Raven provides independent medical evaluations and impairment evaluations in matters involving conditions of the hand and upper extremity. Evaluations are performed for attorneys, insurers, employers, and other entities requiring independent medical analysis, consistent with applicable civil procedure rules, workers’ compensation statutes, and federal maritime law.

In California, these services are provided in civil matters and are separate from the workers’ compensation system (QME/AME).

Scope of Evaluation

Evaluations may address:

  • Diagnosis and extent of injury
  • Causation within reasonable medical probability
  • Degenerative versus traumatic differentiation
  • Necessity and appropriateness of treatment
  • Functional capacity and return to work
  • Permanent impairment
  • Future medical needs

Impairment and Disability Evaluation

Permanent impairment and disability assessments are performed using the AMA Guides, as applicable to the jurisdiction.

Evaluations may include:

  • Whole person impairment calculation
  • Range of motion measurement when indicated
  • Strength and neurologic assessment
  • Application of AMA Guides criteria
  • Apportionment analysis when medically appropriate

Impairment opinions are clearly documented, with methodology explained.

Methodology

Each evaluation is based on:

  • Comprehensive review of medical records
  • Review of imaging and reports when available
  • Detailed medical history
  • Objective physical evaluation when requested
  • Mechanism of injury analysis
  • Differentiation between degenerative and traumatic pathology
  • Structured medical reasoning based on medical probability

A clear distinction is made between subjective complaints, objective findings, and medically supported conclusions. Where evidence is limited, that limitation is stated clearly.

Professional Standards

Evaluations are conducted independently and without advocacy. Compensation is based solely on time and professional services rendered and is not contingent upon outcome.

Opinions are rendered only after formal engagement, execution of an agreement, and receipt of a retainer.
